Official Sweepstakes Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

GENERAL: In these Official Rules, "you" or "your" or “entrant” means the person who has entered this Sweepstakes.  By entering in this Sweepstakes, you agree to be bound by: (i) the terms and conditions contained in these Official Rules; and (ii) any and all decisions of Sponsor in all matters relating to this Sweepstakes. Sponsor reserves the right in its sole discretion to permanently disqualify any entrant it believes has violated these Official Rules.  This Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations.

SWEEPSTAKES ENTRY PERIOD: This Sweepstakes begins at 1:00PM EST on March 15, 2021 and ends at 11:59PM EST on March 16, 2021 (the “Entry Period”).

HOW TO ENTER: You may enter this Sweepstakes by successfully completing all of the steps below during the Entry Period:

  1. Complete the task(s) detailed below for up to four (4) of our social media platforms. You must be a member of the social media platforms through which you participate.
  2. Visit our webpage and complete the form located at https://www.calchipconnect.com/pages/get-lucky-sweepstake. As part of this form, you will be required to identify: (a) the social media platform(s) you followed us on; and (b) your username for each identified social media platform.
  3. Entry IS limited to one (1) per person regardless of the number of social media platforms for which you complete the above steps.

The odds of winning depend on the total number of qualifying entrants. Online entries must be completed and received within the Entry Period to be considered for this Sweepstakes. If any of the information you provide is inaccurate, you will be excluded from this Sweepstakes. Sponsor reserves the right to reject any entries deemed untruthful in its sole discretion. Only one (1) entry may be submitted per person. All additional entries submitted by a single entrant are void. In the event of a dispute concerning entries submitted by multiple individuals using the same email address or username, the entry will be deemed to have been submitted by the authorized subscriber of the email account used to enter the Sweepstakes.

ELIGIBILITY: This Sweepstakes is sponsored and administered by Cal-Chip Connected Devices (“Sponsor”). This Sweepstakes is open only to persons who are 18 years of age or older and open to legal residents of the United States. Void where prohibited or restricted by law. Employees, their immediate families, and household members (whether related or not), of Sponsor, or Sponsor’s affiliates, subsidiaries, divisions, and advertising agencies are not eligible to enter this Sweepstakes. This Sweepstakes is subject to all United States federal, state, and local laws. Sponsor reserves the right to verify the eligibility qualifications of any winner.

PRIZE: Five (5) winners will each receive a RAK Hotspot Miner v2. Details regarding this product can be found at our website: https://www.calchipconnect.com/products/rak-hotspot-miner. The approximate retail value of each prize is $345.00 per unit. The random drawing and awarding of prize(s) will be conducted under the supervision of the Sponsor whose decisions are final and binding in all matters pertaining to this Sweepstakes. Entrants agree to be bound by these Official Rules and the decisions of the Sponsor.

DETERMINATION OF WINNERS: Sponsor will randomly select five (5) winners from all eligible entries received by 11:59PM EST on March 16, 2021 (each, a “Prize Winner”). The random selection will occur on or about 1:00PM EST on March 17, 2021. Once selected, Prize Winners will be verified by Sponsor to confirm each Prize Winner is a member of the social media platform(s) claimed in the entry and that the Prize Winner has completed the requisite steps described in the Section entitled “How to Enter.” Prize Winners will be notified via email or telephone and must reply to the notification within seven (7) days, or the prize will be forfeited and an alternate winner will be selected. Each winning entry will be confirmed by appropriate employees of Sponsor whose decisions are final on matters relating to this Sweepstakes. Sponsor is not responsible for any changes to a Prize Winner’s email address or other information which may interfere with winner notification. To qualify for a Prize, a Prize Winner may be required to sign an Affidavit of Eligibility, Consent to Publicity, Liability Waiver, and federal and state tax release, all of which must be executed and returned within seven (7) days of the issuance of notification or such other date set forth in the notification by Sponsor. Failure to comply with all instructions in a Prize notification, or if a Prize is not claimed within seven (7) days after Prize notification or is returned as non-deliverable, may result in disqualification of the entry and the selection of an alternate Prize Winner.

PRIZE TERMS: Sponsor will strive to deliver prize within four (4) weeks of the confirmation of the Prize Winner, subject to any shipment delays of the manufacturer. Any federal, state, and local taxes and any duties on a Prize are the sole responsibility of the Prize Winner. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. No substitution or transfer of the Prize will be offered or permitted. If a Prize is unavailable, Sponsor reserves the sole right to substitute a prize of equal or greater value. Redemption of all Prizes is subject to all standard terms, conditions, and restrictions applicable to the Prize on the day of issuance.

CONDITIONS OF ENTRY: An eligible entrant must enter by completing the entry procedures as described in these Official Rules. All entries submitted that are not in compliance with these Official Rules are void. Incomplete entries are void, including any inappropriate, incomplete or duplicative entries. Neither Sponsor, nor Sponsor Parties (defined below), assumes any responsibility for late, lost, illegible, misdirected or postage-due entries. Any entrant that provides materially false information shall be disqualified. By entering, entrants accept and agree to these Official Rules, including all eligibility requirements. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. By submitting any information or content to Sponsor Parties, you represent that you have the full legal right to provide such information and that use of the information by Sponsor Parties will not (a) infringe any intellectual property rights of any person or entity or any rights of publicity, personality, or privacy of any person or entity; (b) violate any law, statute, ordinance, or regulation; or (c) constitute disclosure of any confidential information owned by any third party.

RELEASE: By entering this Sweepstakes, you hereby certify that you have complied with all the rules of this Sweepstakes and that you have committed no fraud or deception in entering this Sweepstakes or in claiming any Prize. The winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes.   

BY ENTERING THE SWEEPSTAKES OR ACCEPTING ANY PRIZE, EACH ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND AGREES THAT SPONSOR AND ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, AND ALL OTHER ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF THE SWEEPSTAKES (COLLECTIVELY, “SPONSOR PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY, THE ENTRANT FOR ANY LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR ANY PRIZE RELATED ACTIVITY. SPONSOR PARTIES DISCLAIM ALL WARRANTIES AND THE SELECTED Prize WinnerS WAIVE ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EACH ENTRANT AGREES TO RELEASE, INDEMNIFY AND HOLD THE SPONSOR PARTIES HARMLESS FROM AND AGAINST ANY CLAIMS OF LIABILITY, LOSS OR DAMAGE, JUDGMENTS, COSTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY’S FEES AND ATTORNEY’S DISBURSEMENTS) ARISING OUT OF OR INCURRED IN CONNECTION WITH THEIR PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE OR USE/MISUSE OF ANY PRIZE AWARDED BY SPONSOR.

THE SPONSOR PARTIES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, INCLUDING LOST REVENUES OR LOST PROFITS, WHICH MAY OR DOES RESULT FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR ANY PRIZE RELATED ACTIVITY, REGARDLESS OF LEGAL THEORY, EVEN IF THE REMEDIES OTHERWISE AVAILABLE FAIL OF THEIR ESSENTIAL PURPOSE. UNDER NO CIRCUMSTANCES WILL THE TOTAL LIABILITY OF THE SPONSOR PARTIES IN CONNECTION WITH, BASED UPON, OR ARISING FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR ANY PRIZE RELATED ACTIVITY EXCEED THE AMOUNT OF THE PRIZES.

SOCIAL MEDIA PROMOTION: Although the Sweepstakes may be featured on LinkedIn, Twitter, Facebook, Instagram and/or other social media platforms, the Sweepstakes is in no way sponsored, endorsed, administered by, or association with LinkedIn, Twitter, Facebook, Instagram and/or such other social media platforms and you agree that LinkedIn, Twitter, Facebook, Instagram and all other social media platforms are not liable in any way for any claims, damages or losses associated with the Sweepstakes. 

MISCELLANEOUS: Sponsor Parties are not responsible or liable for any events beyond their control, which may cause this Sweepstakes to be stopped, including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, nor are they responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error, filtering or traffic congestion on the internet or at any web site, insufficient space in an entrant’s account to receive messages or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participation in this giveaway or downloading any materials in this Sweepstakes. If, for any reason, this Sweepstakes is not capable of being conducted as planned, including due to tampering, unauthorized intervention, typographical errors, technical failures, fraud, low participation, or any other causes beyond the reasonable control of Sponsor Parties that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor Parties reserve the right at their sole discretion to cancel, terminate, modify, or suspend this Sweepstakes. Sponsor Parties reserve the right in their sole discretion to disqualify any individual found to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. When used herein, the words “includes” and “including” and their syntactical variations shall be deemed followed by the words “without limitation.” ANY ACT OR ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ACT OR ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ACT OR ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

CHOICE OF LAW AND JURISDICTION: All applicable federal, state, provincial and local laws and regulations apply. This Sweepstakes and all matters, issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, Prize Winners, and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania of the United States, without giving effect to any choice of law or conflict of law rules or provisions (whether of the Commonwealth of Pennsylvania or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania. You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively by arbitration in a location selected solely by Sponsor.
